Terms and Conditions of Sale
Preamble
These Terms and Conditions of Sale apply, unless otherwise agreed between the parties, to all sales of goods and/or related services carried out by SIXOFA SAS, with a share capital of €2,000, whose registered office is located at 419 avenue de l'Europe, 83140 Six-Fours-les-Plages, France, registered with the Toulon Trade and Companies Register under number 817 785 827, intra-community VAT number FR 28 817 785 827 (hereinafter referred to as “SIXOFA”), and by any person wishing to make a purchase via SIXOFA’s e-commerce website canopea-paris.com (the “Site”), hereinafter referred to as the “Customer”.
The Site enables the Customer to order CANOPEA branded products (the “Product(s)”) online in accordance with these Terms and Conditions. The Site and all associated rights are the exclusive property of SIXOFA. Any reproduction, whether in whole or in part, is subject to prior authorization. However, hyperlinks to the Site are permitted without specific authorization, provided that SIXOFA cannot be held liable if the content of such third-party websites violates applicable laws and regulations.
Acceptance of Terms
By validating an order on the Site, the Customer declares that they have read, understood, and unreservedly accepted these Terms and Conditions of Sale.
These Terms apply as of the date of the order and may be modified at any time. They are accessible at:

Products and Compliance
Prior to placing an order, the Customer may review the essential characteristics of the Products on the Site. SIXOFA reserves the right to modify the range of Products at any time, without affecting orders already placed.
Images, texts, graphics, and product descriptions are non-contractual. SIXOFA cannot be held liable for errors, omissions, or modifications. SIXOFA also disclaims liability for malicious third-party actions altering Site content.
Availability
If a Product is unavailable, SIXOFA will inform the Customer as soon as possible. If unavailability occurs after order confirmation, the Customer will be notified by email and may cancel the order and receive a refund if applicable.
SIXOFA shall not be liable for any resulting damages. Promotions and offers are valid only while displayed on the Site and within available stock limits.
Orders
Automated systems serve as proof of the order’s content and date. Orders are confirmed by email. A sale is only final after payment validation by the relevant banking institution.
SIXOFA reserves the right to cancel any order in case of a prior payment dispute. The Customer is responsible for the accuracy of the information provided. Any order implies acceptance of these Terms, as well as product descriptions and prices.
Prices
Prices are displayed in euros, including all taxes (VAT), excluding shipping, processing, and packaging fees. These additional costs are specified before final validation.
Prices may be changed at any time without notice. Products are billed based on the rates in effect at the time of order registration.
Payment
Full payment is required at the time of order. Payments are secure and may be made by Visa, MasterCard, American Express, Aurore, Cofinoga, or 4 étoiles cards.
Ownership of the Product remains with SIXOFA until full payment has been received.
Invoice
Customers can download and print invoices via their account under “My Orders”.
Delivery
SIXOFA delivers within France, the European Union, the Maghreb, Turkey, and most other countries. Products are shipped to the address provided by the Customer.
Delivery times are indicative. The Customer must ensure the accuracy of delivery details. Deliveries cannot be made to PO boxes, campsites, or hotels.
In case of absence, parcels are held for 15 days before being returned. Shipping costs remain the Customer’s responsibility in such cases.
Orders may be delivered in multiple shipments at no extra charge. For delays exceeding 7 working days before dispatch, the Customer may cancel the order.
Damaged parcels must be reported within 3 days. SIXOFA is not liable for delays beyond its control.
Customs Duties and Taxes
For deliveries outside mainland France, customs duties and taxes may apply and are the Customer’s responsibility. SIXOFA declines any liability in case of non-payment.
Withdrawal, Returns, and Exchanges
Right of Withdrawal:
Customers have 14 days from receipt to withdraw without justification. Return requests must be made by email prior to sending back Products.
Products must be returned within 7 days after approval, unused, with original packaging and tags, at the Customer’s expense.
Refunds are issued within 14 days of receipt, excluding shipping costs.
Defective Products:
Claims must be made within 3 working days. Approved returns must follow the same conditions. Products will be replaced or refunded if unavailable.
Items returned worn, washed, or without tags will not be refunded.
Warranty
The contract is governed by French law. Customers benefit from legal warranties against hidden defects (Articles 1625 and following of the Civil Code).
Liability
SIXOFA is bound by an obligation of means. It is not liable for issues related to internet use, force majeure events, or misuse of products.
Liability is limited to the value of the Product.
Disputes
In case of dispute, the Customer is encouraged to seek an amicable solution. Failing that, jurisdiction is assigned to the courts of the defendant’s domicile or place of delivery.
Customer Account
Login credentials are personal and confidential. The Customer is responsible for their use. SIXOFA may suspend or terminate accounts in case of breach.
Data Protection
Personal data is required for order processing. Customers have rights of access, modification, and deletion under French law (CNIL).
Web Beacons
The Site may use anonymous tracking tools to measure traffic and improve services.
Electronic Signature and Proof
Electronic records have the same legal value as handwritten signatures under French law.
Entire Agreement
These Terms and the order summary form the entire agreement between the parties.
Intellectual Property
All Site content is protected and remains the exclusive property of SIXOFA. Unauthorized use is prohibited.
Force Majeure
SIXOFA is not liable for failure due to force majeure events (strikes, natural disasters, etc.). Contracts may be terminated after one month of interruption.
Amendments
SIXOFA reserves the right to modify these Terms at any time.
Assignment
Contracts may be transferred by SIXOFA without Customer consent.
Severability
If one clause is invalid, others remain in effect.
Applicable Law
These Terms are governed by French law, regardless of the Customer’s location.
