General Provisions

These general conditions of sale define the rights and obligations of SIXOFA and of the Customer in regards to the products presented by SIXOFA on its website canopea-paris.com (hereinafter referred to as "the Site"). They apply exclusively between the company SIXOFA, 60 chemin de la Rippe, 01220 Divonne les Bains, Siret: 817 785 827 (hereinafter referred to as "SIXOFA") and any physical human consumer visiting or making a purchase via the website itself (hereinafter referred to as "the Customer").

On the Site, SIXOFA allows the customer to order online products from the brand CANOPEA (hereinafter referred to as "the Product(s)") according to the present terms and conditions.

In general, all copyrights, trademarks and other distinctive signs and property rights or intellectual property appearing on the Site, will remain the full property of SIXOFA. The Customer is therefore obliged to respect intellectual property rights and will not in any way use the trademarks appearing on the Site and on the Products in any eventuality, or deposit a trademark that would prejudice the rights of the owner, unless otherwise stated by contract.

Acceptance of Conditions

By confirming an order on the Site, the Customer declares having read, understood and accepted the Terms and Conditions here listed. Any order placed via SIXOFA therefore entails the unconditional acceptance by the Customer of these conditions.

SIXOFA reserves the right to modify the current general conditions at any time without notice; the applicable conditions are those in effect on the date of the order by the Customer.

Product and Accuracy

The products offered for sale are those described and available on the Site, within the limit of available product stock. SIXOFA takes the greatest care in the presentation and description of the products in order to provide the Customer with the best possible information. However, some non-substantial errors may appear on the Website, which the Customer acknowledges and agrees to.

Elements such as images, text, graphics and all the information and characteristics illustrating and/or accompanying the products are not contractual, which the Customer acknowledges.

As such, SIXOFA does not incur any liability for error or omission of any of these items or in case of modification of said elements by suppliers and/or publishers.

Availability

Stock availability is updated in real time. Nevertheless, errors occurring during the update cannot held the liability of SIXOFA.

SIXOFA cannot be liable in case of an order cancellation because of stock depletion. If, despite the vigilance of SIXOFA, products are unavailable, SIXOFA will inform the Customer by e-mail as soon as possible. The Customer may then cancel the order and refund, if applicable, the amounts already paid.

The permanent or temporary unavailability does not in any way engage the responsibility of SIXOFA nor does it imply any right to compensation or damages in favour of the Customer.

Orders

Acceptance of an order placed on the Websites are subject to compliance with the procedure put in place by SIXOFA, expressed by a succession of different stages that the Customer shall follow in order to validate their order.

The Customer may at any time change or remove the products added in its bag (the “Bag”). The Bag summarizes the products selected by the Customer, as well as its price, V.A.T. and shipping costs, excluding customs and other taxes. The Customer may modify at any time its Bag before validating the order.

The price paid by the Customer doesn’t include customs and others taxes. Such additional costs shall be directly paid by the Customer to the carrier. SIXOFA cannot be held responsible for any customs, taxes or information regarding these. It is the Customer’s responsibility to find the correct information regarding customs fees in their country of delivery.

Order refusal

SIXOFA reserves the right to remove at any time any product displayed on the Websites and/or to replace or modify any content or information related to any product. Despite the best efforts of SIXOFA to satisfy the client expectations, SIXOFA may be obliged to cancel an order even after having sent a confirmation by email. In such case, the order will be reimbursed.

SIXOFA cannot be held liable to the client or a third party in case of the removal of a product from the Websites, and in case of the replacement or modification of any content published on the Websites or refusal of an order after having confirmed it by email.

SIXOFA reserves the right to refuse or cancel any Order placed by a client with whom SIXOFA has currently a dispute concerning the payment of a previous order or an objective suspicion of fraud.

Price and payment terms

The prices displayed on the Site are indicated in Euros including French tax charges (French VAT and any taxes eventually applicable), excluding shipping costs, order-processing costs and packaging costs, and excluding any customs duties and other taxes.

Certain countries outside the European Union may be subject to additional charges (duties, taxes) upon reception depending upon the legislation of their country. Import fees and others taxes are at the Client’s charge and can be paid directly to the Transport Company or local customs office.

The shipping costs, order processing costs and packaging costs will be included in the basket of the Customer, before final confirmation of the order.

SIXOFA reserves the right to modify its prices at any time but the products will be invoiced and paid on the basis of the rates in force at the time of placing the order, subject to availability. The products are payable on the day of the order.

The purchases shall be settled either via PayPal, or via the secure platform provided by our partner OGONE INGENICO.

SIXOFA does not keep any record of banking information from the Client. Invoices and purchase history is available in the 'my account' section.

Order delivery

SIXOFA delivers to all countries of the European Union and any where in the world except China, North and South Korea and Taiwan for legal reasons.

The delivery is made to the delivery address indicated by the Customer, being specified that it must be the address of the customer's residence, an individual of their choice or a legal entity (delivery to their company).

The Customer must make sure that they have provided accurate and complete information concerning the delivery address (including in particular: house number number/name, building number/name, staircase, access codes, names and/or numbers for the intercom, etc.). In case of inability to deliver the products at the address indicated by the client, products will be returned to SIXOFA, which reimburse the Customer within fourteen (14) days of the products’ receipt by SIXOFA.

Deliveries cannot be made either to hotels, camping groups, airports or P.O. boxes.

The transport company will deliver the order at the address provided by the Customer. In case of absence, the order can be kept for 15 days at the Customer’s local post office. Past this delay, if the order is returned to SIXOFA, it will reimburse the price of the products, excluding shipping costs, which will remain at the charge of the Customer.

SIXOFA garantees to keep the Customer informed about the status of his order, with information made available from carriers.

It can occur that an order is delivered in two separate deliveries. In that case, the Customer only pays for one delivery. If the Customer wants to deliver in two separate addresses, he must place two separate orders and pay subsequent shipping fees.

Rights returns & refunds

- Withdrawal right’s duration and conditions

Any non-professional customer could use its withdrawal right during a period of fourteen (14) days from the Delivery. In such case, the client must fill the return form available in their personal account in the orders section, either by sending an email via the contact form online.

- Return policy

The products must be returned to SIXOFA within 14 days from the use of the withdrawal right by the client. After such 14 days, the sale is final. The products shall be returned with its original packaging, with the original labels attached, brand new, without having used it or washed it.

Return of the product(s) is the responsibility of the customer if the order was placed from abroad and is at their own risk. SIXOFA can not be held responsible for returns sent by the customer's own transport means.

Return is free-of-charge if the order was placed from metropolitan France and Belgium. In such case, the customer must use the prepaid shipment label in order to facilitate the reimbursement of the order. Customers from all other countries are responsible for shipping costs, applicable customs fees and safe delivery to our warehouse.

If the client does not adhere to these terms and conditions, including conditions of return or exchange, SIXOFA cannot proceed to refund the products in question.

- Refunds

A refund by SIXOFA for the order returned is made within 14 days following reception of the Products in excellent condition. Shipping fees are not refundable.

Repayment will be made through the same payment means used to pay the Order. If the payment means is expired, the Client shall contact the customer service to update the payment means. SIXOFA cannot be liable if the repayment is made on an expired payment means.

Guarantees and Responsability

If an order takes 7 working days to be shipped and if the items have not been sent out already, the Customer can write a claim asking for refund. In case the order was returned to SIXOFA, the company needs to respond to the Customer to inform them of the reasons the order was not shipped and will seek an alternative solution or offer a refund.

If an order was shipped before the canceling of the order, the Customer will return the order to SIXOFA who will then reimburse the items upon reception of the items in their original conditions, including attached labels. SIXOFA will not be responsible for any return customs fees to our warehouse. Customers will need to either specify "return" on their return label or settle applicable customs fees in order for a return to be accepted by our warehouse.

If an order was received damaged or incomplete, the Customer will inform SIXOFA by all means possible with 3 days following reception of the order.

SIXOFA cannot be liable for the late Delivery caused by their transporter or a case of force majeure (as defined below).

- Damaged products

SIXOFA is only required to deliver products which are compliant with the contractual provision. Products are considered as compliant if the following conditions fulfilled : (i) they shall be compliant with the description and have the features mentioned on the Websites; (ii) they shall be compliance with the uses which may reasonably be expected of it; (iii) they shall compliant with the quality and strength which may reasonably be expected of similar products.

- Procedure

In case of visible defect of a Product, the customer shall send a demand to sav@canopea-paris.com within 3 days from the Delivery date with a photo of the products. All demands shall mention the defect concerned. Failing that, the demand won’t be accepted and no return or exchange will be possible. Once validated, the Product shall be returned within seven (7) working days following the email confirmation. The product must be returned with its original packaging, with the original labels, brand new, without having used it or washed it, and which the Order reference and copy of such demand shall be sent by mail to the following address:

If the Product is not returned within seven (7) days following the email confirmation, the return will be cancelled and the Customer will be considered to have kept the Product.

If the Product does not respond to the description advertised, SIXOFA commits to: - replace the Product by a similar Product depending on available stocks - reimburse the Product within fourteen (14) working days if replacing the item proved to be impossible, using the same payment method used for the order.

If the Customer receives an item in error, he must immediately inform Customer Service in order to make an exchange, and must do so before using the product. If the Customer removes the label from the product received in error, he will be unable to return it. If a product is worn, washed or has its label removed - even received in error, it will be considered as accepted by the Customer and will not be refunded.

If the Product presents visible defaults, SIXOFA commits to the below after review to: - reimburse the full amount paid if the Product is returned, or reimburse parts of the Product if the Client decides to keep the product nevertheless.
